On the 17th of April, the Supreme Court (SC) issued a notice to the health universities in Telangana State and Andhra Pradesh, both the States’ Union Health Secretary and the Directorate General of Health Services.

While serving the notice, the SC asked the accused parties about their stand about a public interest petition, which said the parties bent the rules for PG admissions and interpreted them in their own way.


The petition was filed by Justice V. Eswaraiah, the President of the All India Backward Classes Federation. According to the petition filed by the President, the laws state, whenever a backward class (BC) student is admitted based on his/her marks under the open category, he/she should be treated as an open candidate and not as a reserved student.


“In online admissions process, all meritorious candidates have the facility of choosing their speciality irrespective of the speciality subject seat he or she was initially allotted. This is called sliding. But when a BC merit candidate slides for a speciality subject of his/her choice the officials vacate a BC seat nd allot that seat to BC merit candidate. As a result, the seats meant for BCs are being reduced and open merit BC are being shown in reserved BC category. As 27% seats are to be filled by OBCs, the officials are supposed to keep BC quota intact regardless of these slidings. This sliding method is being implemented in a faulty manner that is detrimental to the interests of BCs,” Justice Eswaraiah said.

The Justice’s petition was heard by a bench consisting of Justice S.A. Bobde and Justice S. Abdul Nazeer. While filing the petition, Justice V. Eswaraiah asked the Supreme Court not to reduce the quota reserved for the BCs and not to let the rule sliding issue affect how many people are admitted through this category.


The SC is still waiting to hear from the concerned parties against whom the petition was filed.
