With President Ram Nath Kovind approving the appointment of four new judges to the Supreme Court (SC,) the count of SC judges increased to 31 for the first time since the year 2008. With the addition of Justices Aniruddha Bose, A.S. Bopanna, B.R. Gavai and Surya Kant, the SC now has a full house.

The sanction to increase the number of judges from 26 to 31 was passed in 2008. The names of Justices Bose and Bopanna were previously returned by the Government to the collegium headed by Chief Justice of India (CJI) Ranjan Gogoi. Earlier, the names of Justices Bose and Bopanna were earlier returned by the Government because of seniority and representation of regions. However, after a review, the collegium reiterated its reasons for including the judges stating there was no discrepancy in terms of competence, integrity or conduct.

Reacting to the rejection of the two judges, the collegium said it was recommending Bopanna and Bose so as to provide due representation as much as possible. The collegium wanted to increase representation of the judges in the Supreme Court, irrespective of background and belonging to the SC/ST/OBC categories, women and minorities.

Among the four judges appointed, Justice Gavai is the seniormost. In fact, according to sources, he could replace CJI Ranjan Gogoi as the next Chief Justice of India in 2025. Justice Bose is the Chief Justice of the Jharkhand High Court, he stands at number 12 in terms of seniority across India. Justice Bopanna, on the other hand, is the Chief Justice of the Gauhati High Court and stands at number 36. Justice Kant is the incumbent Chief Justice of the Himachal Pradesh High Court.

The appointment of the Justices took place a day before the Lok Sabha election results were declared.
