Supreme Court Gives its Verdict on Triple Talaq

On Monday, the Supreme Court announced its verdict and termed the practice of triple talaq as unconstitutional. The Supreme Court ordered the Government to enact a legislation regarding it.

The Supreme Court also said that triple talaq will be barred until the Parliament makes a law on it. A temporary injunction against triple Talaq was ordered by the Supreme Court.

At the hearing, the court requested all political parties to concentrate on making a decision on the matter. The Court also showed concern and requested the legislature to keep in mind Muslim law while making the law.

The case was heard by a bench of five judges with members from all different faiths, Hindu, Muslim, Christian, Islam, Sikhism and Zoroastrianism. The members were Chief Justice Jagdish Singh Khehar with Justices Kurian Joseph, Rohinton Fali Nariman, Uday Umesh Lalit and Justice S. Abdul Nazeer.

Triple Talaq has been prevalent for a very long time and has also been made illegal in many Islamic countries.

Many against triple Talaq believe that the practice of such a divorce is discriminatory towards women and is against their basic fundamental rights.
