On the 20th of October, Wednesday, the special Narcotics Drugs and Psychotropic Substances (NDPS) Court, Mumbai, denied bail to Mr. Aryan Khan, the son of superstar Shah Rukh Khan in the Cruise Drug case.

Justice V.V. Patil of the special NDPS Court heard the bail plea and rejected it after hearing the arguments of the Narcotics Control Bureau (NCB.)  

During the Court hearing, Mr. Anil Singh, the advocate representing the NCB, put forward his arguments and said, Aryan Khan is a regular consumer of drugs and has involvement.  He also produced some WhatsApp chats and evidence, proving involvement of Aryan Khan with drugs in the past few years. 

Nullifying the arguments, Mr. Amit Desai, the lawyer of Aryan Khan said, “Government’s own policy speaks of being sensitive to students of schools and colleges and having a different approach for peddlers…Bombay High Court in a previous order did not agree with the contention that celebrities are to be treated harshly, stating that they are equal before the law.”  He further highlighted WhatsApp chats and said, “The youth of today speak in a language what the older generation would call ‘torture’ of english language. How they joke with each other, how their relationships are with each other is very different.  The language is beyond me. The chats, is it youthful banter, is it a joke, the context is important. The court needs to bear in mind that by no stretch of the imagination is this boy involved in international drug trafficking.”

Mr. Desai concluded his arguments with, “Nothing has been suggested on how the investigation will be affected if he (Aryan) is granted bail.”

The Court heard both sides of the arguments and denied the bail. 

Under police custody since the 7th of October, once again, Aryan Khan’s bail plea has been rejected by the special court.  Along with Aryan Khan, seven other accused in the Cruise Drug case have been remanded to judicial custody.  The other people arrested in the drug case along with Aryan Khan are Arbaaz Merchant, Mohak Jaswal, Nupur Satija and Munmun Dhamecha. 

On the 3rd of October, Aryan Khan, 23 years old, was arrested by the Narcotics Control Bureau (NCB) officials for his involvement in a drugs related case.  Aryan Khan was arrested with seven others during a raid at a cruise party, where drugs were available and consumed.  The raid started at 10 A.M., on Sunday night and continued till 2:00 P.M.  After the intensified search, the anti drug agency found Aryan Khan was involved.  Initially Aryan Khan and others were under the NCB custody, but on the 7th of October, all the accused were remanded to judicial custody.  They are currently in the Arthur Jail, Mumbai, Maharashtra. 

Meanwhile, after being denied bail, Mr. Amit Desai, the lawyer representing Mr. Aryan Khan moved the Bombay High Court against the bail rejection of the special NDPS court.  The petition filed in the Bombay High Court is expected to be heard by a single bench judge at 10:30 A.M., on the 21st of October. 

Aryan Khan has been booked under Sections 27 (punishment for consumption of any narcotic drug or psychotropic substance), 8C (produce, manufacture, possess, sell or purchase of drugs) and other relevant provisions of the Narcotics Drugs and Psychotropic Substances Act (NDPS.) 

In addition, the NCB is continuing their investigation in the drug matter.
