On the 28th of October, Thursday, the Bombay High Court (HC,) approved the bail plea of Aryan Khan, the son of Bollywood superstar Mr. Shah Rukh Khan.

On the 3rd of October, Aryan Khan, 23 years old, was arrested by the Narcotics Control Bureau (NCB) officials for his involvement in a drugs related case. Aryan Khan was arrested with seven others during a raid at a cruise party, where drugs were available and consumed. The raid started at 10:00 A.M., on Sunday night and continued till 2:00 P.M. After the intensified search, the anti drug agency found Aryan Khan was involved. Initially Aryan Khan and others were under the NCB custody, but on the 7th of October, all the accused were remanded to judicial custody. They are currently in the Arthur Jail, Mumbai, Maharashtra.

Aryan Khan has been booked under Sections 27 (punishment for consumption of any narcotic drug or psychotropic substance), 8C (produce, manufacture, possess, sell or purchase of drugs) and other relevant provisions of the Narcotics Drugs and Psychotropic Substances Act (NDPS.)

Almost a month after the arrest, Justice Mr. N.W. Sambre of the Bombay HC approved the bail petition to Aryan Khan and the co accused Ms. Munmun Dhamech and Mr. Arbaaz Merchant. However, a detailed bail order would be given by the Court on the morning of the 29th of October. Therefore, Aryan Khan and other accused in the Cruise Drug Case matter would be released tomorrow, the 29th of October, Friday.

Today’s court hearing details:

While Mr. Mukul Rohatgi was representing Mr. Aryan Khan, Advocate Mr. A.G.S. Anil Singh was representing the NCB. Besides these two advocates, the Bombay HC bench also heard Senior Advocate Mr. Amit Desai for Arbaaz Merchant and Advocate Ms. Kashiff Ali for Munmun Dhamecha.

The NCB opposed the bail demand and said, the accused are part of a larger conspiracy and interrogation is needed. The lawyers of the NCB on behalf of the agency said, Aryan Khan has international links and is thus required for further interrogation to unearth the truth. Therefore, the NCB representatives asked the Bombay HC not to grant him bail in the Cruise drug matter. The NCB also said Aryan Khan is an influential person and attempts have already been made to influence witnesses and tamper with evidence.

Meanwhile, arguing on behalf of Aryan Khan, his lawyer said the arrest was made in sheer violation of Article 22 of the Constitution, inasmuch as he was not informed about the correct grounds for arrest. Later, Mr. Mukul Rohatgi said, there were no traces of drugs found on Mr. Aryan Khan and the NCB registered the case only on the basis of drugs on the cruise ship and WhatsApp chats of his client, which is not legal evidence.

After hearing the back and forth argument of the NCB and Aryan Khan’s lawyers, the Bombay HC granted bail to Shah Rukh Khan’s son and two other accused arrested in the case.

The bail grant came 25 days after the arrest, after being constantly rejected by the special Narcotics Drugs and Psychotropic Substances Act (NDPS) Court and Bombay HC. The last hearing in the matter was held yesterday, the 27th of October, which was postponed to today, the 28th of October.

Finally, after days, Aryan Khan would be leaving for his home, but he is not allowed to leave the country as the investigation is going on.

Meanwhile, the NCB is also conducting the investigation in the 2nd of October’s raided Cruise Drug Case.
