The U.S. President Donald Trump is working on the Buy American, Hire American proposal which can lead to large scale deportation of foreigners on H-1B visa. The H-1B visa is granted to foreigners and is applicable for three years with one extension adding up to three more years. A time period of 6 years is given including the extension, after which the visa holder has to return to their own Country. If approved for Green Card, the person can stay in the U.S. using further extensions. The people on H-1B visa are mostly Indians.

The Buy American, Hire American proposal has been circulated in the Department of Homeland Security (DHS.) The DHS oversees citizenship and immigration of the foreigners. Once the proposal is cleared, the Trump Administration intends to end the provision of granting extensions to the H-1B visa holders with a Green Card.

It is said an estimated count of 500,000 to 750,000 Indian H-1B visa holders will be deported if the Trump Administration’s proposal is accepted. The Buy American, Hire American proposal is focussed on boosting the manufacture and protection of local jobs for Americans.

An official of Immigration Voice said, “If implemented this could lead to large scale deportations, mostly of Indians, throwing hundreds and thousands of families into crisis.” Immigration Voice is an advocacy body in San Jose, California. The Official further added Immigration Voice is planning to mount a challenge through outreach and sue when a decision is announced.

The proposal is based on the power of discretion the United States Citizenship and Immigration Services (USCIS) holds. The USCIS officials decide the extensions to be given to the H-1B visa holders waiting for a Green Card. They hold the power to extend the visa from 1 to 3 years and also have granted some visa holders as many extensions as needed.

The U.S. grants 85,000 non immigrant H-1B visas each year. A total of 65,000 visas to foreigners hired abroad and 20,000 to foreigners enrolled in advanced degree courses. It is said 70% of the visas go to Indians hired mostly by American companies. The American companies include Facebook, Microsoft, Google and some American arms of Indian tech giants such as Infosys, Wipro and Tata Consultancy Services (TCS.)

In February 2017, Trump planned to pull back Employment Authorization for Certain H-4 Dependent Spouses (H-4 EAD.) The H-4 EAD is a regulation introduced by Former U.S. President Barack Obama to attract highly skilled foreign workers by granting authorization to spouses of H-1B visa holders.
