Prakash Javadekar, the Human Resource Development (HRD) Minister of India, yesterday (Tuesday,) announced the implementation of the Constitution (103rd Amendment) Act, 2019 in all the educational institutions across India.

What does the Constitution (103rd Amendment) Act, 2019 entail?

The Constitution (103rd Amendment) Act, 2019, passed by the Government of India, provides 10 % reservation for admission to educational institutions and for job recruitment. The 10 % reservation is aimed at benefiting the economically weaker sections (EWS) belonging to the General Category.

What change will the Constitution (103rd Amendment) Act bring in the field of education?

With the implementation of this Act, approximately 25 % seats will be added to accommodate more students for admission to all the education institutions for courses such as Science, Arts, Commerce and Management. The additional seats will help more students pursue higher education.

The increased 25 % seats will also ensure the new Act does not disturb the existing 50 % quota provided to the Scheduled Castes (SCs,) the Scheduled Tribes (STs) and the Other Backward Classes (OBCs.)

Mr. Javadekar, held a press conference, yesterday, and said, “We have more than four million students pursuing higher education. The number of students will increase.” He further added, “If we have 100 students going for education, with this quota we will have 125 pursuing higher education. The implementation of the new rule will not disturb the existing reservation policy for SC/ST and OBC.”

When will the Constitution (103rd Amendment) Act be implemented and which institutions will it affect?

Mr. Javadekar assured the implementation of the quota within a week and asked the universities and colleges to introduce the same in their prospectuses.

Mr. Javadekar said, the quota for the EWS will be implemented in all the government and private institutions across India from the academic session beginning this year (2019.)

In light of this, Mr. Javadekar said, “From the 2019 academic session, we will implement the 10% EWS reservations in both private and public institutes. There are 900 universities and 40,000 colleges which will reflect the implementation in the prospectus of 2019.”

The decision came after the Government, the members of the University Grants Commission and the All India Council for Technical Education (AICTE) held a meeting, yesterday, and discussed the same.
