NGO Challenges M. Nageswara Rao Appointment

Common Cause, a non governmental organisation (NGO,) on Monday, challenged the appointment of M. Nageswara Rao as the interim Central Bureau of Investigation (CBI) Director, after the removal of Alok Verma as the CBI Director. Common Cause challenged the appointment by filing a petition in the Supreme Court (SC.)

Activist Anjali Bhardwaj claimed, the appointment of Mr. Rao was illegal and sought actions against the same.

Advocate Prashant Bhushan, on behalf of the NGO, filed the petition, which states, “Delhi Special Police Establishment (DSPE) Act as amended by the Lokpal and Lokayuktas Act, 2013, provides for the appointment of the CBI, Director by a high-powered selection committee which does not have a preponderance of the government and its representatives. The committee consists of the Prime Minister, the Leader of Opposition and the Chief Justice of India or any Judge of Supreme Court nominated by him.” It further states, “It appears that this particular committee has been completely bypassed by the Union of India, which has arbitrarily and without any jurisdiction appointed Shri Nageshwar Rao as Interim Director, CBI on January 10, 2019.”

The petition alleges, the appointment of M. Nageswara Rao is an early one, which the Supreme Court dismissed during the previous hearing on the 10th of January, thereby making the process illegal.

According to the petition, there must be transparency while shortlisting, electing and appointing the CBI Director, based on the recommendations of the Selection Committee.

The Central Government, on the 24th of October, appointed M. Nageswara Rao as the interim CBI Director after sending two CBI officers on compulsory leave.

Alok Verma, the former CBI Director and Rakesh Asthana, the former CBI Special Director, were sent on compulsory leave after they accused each other of corruption and bribery.

Alok Verma filed a petition against the orders of the Central Government and after several hearings, a Selection Committee reinstated him as the CBI Director. However, after probing the matter further, the Selection Committee removed Mr. Verma as the CBI Director and posted him as the chief of Fire and Services. Mr. Verma, however, refused the post and submitted a resignation letter, following which M. Nageswara Rao was made the interim CBI Director once again.
