The Supreme Court (SC) on the 20th of January, Thursday, reviewed a petition filed against the reservations in medical institutions.
Recently, the Central Government announced 27% reservation for the Other Backward Class (OBC) and Economically Weaker Section (EWS) students, who cleared National Eligibility Entrance Test (NEET) exams for medical institutions admission. While the decision was welcomed by many, a few merit students and association filed a petition against OBC/EWS reservation. Notably, a group of petitioners led by Neil Aurelio Nunes moved the top court challenging Centre’s July 29, 2021 notification to implement OBC and EWS reservation in NEET-All India Quota from the current academic session in the postgraduate courses.
However, on January 20, the Top Court allowed 27% reservation by Central Government for OBC/EWS for medical institutions admission. The SC bench led by Justice Mr. D.Y. Chandrachud said, “Reservation is not at odds with merit but furthers the distributive consequences of social justice.” The bench further said, “Competitive exams do not reflect economic social advantage which is accrued to some classes. Merit should be socially contextualised.”
Furthermore, the SC bench said criteria to determine EWS quota will be heard in March.
