CJI Impeachment: Jaitley Attacks Congress Over Revenge Petition

According to Finance Minister Arun Jaitley, the impeachment motion against CJI Dipak Misra is being used as a political tool and a revenge petition. The impeachment petition was raised by 7 opposition parties including the Congress Party and signed by a total of 71 ministers.

In a post titled, “Judge Loya Death Case: The One That Almost Created a Judicial Mutiny” Jaitley talks about how the Congress is politicising the issue. The post reads, “My preliminary reaction to the impeachment motion filed today is clear. It is a revenge petition after the falsehood of the Congress Party has been established in the Justice Loya death case. It is an attempt to intimidate a Judge and send a message to other Judges, that if you don’t agree with us, fifty MP’s are enough for a revenge action.”

The Finance Minister further stated the issues with the CJI Misra have been resolved. He said, “The Congress Party and its friends have started using impeachment as a political tool.”

After filing the petition with Vice President Venkaiah Naidu, the opposition released a statement explaining their move, “The Constitution allows only one recourse to remedy the situation. Since there is no other way to protect the institution except to move on (sic) impeachment motion, we, members of the Rajya Sabha, do so with a heavy heart.”

This move comes after the Supreme Court Bench headed by CJI Misra ruled the death of Judge B. H. Loya in 2014 as natural and no investigation was needed. Judge Loya’s mysterious death occurred at the time he was deciding on the murder charges against BJP President Amit Shah.    

It is not an easy task to have the Chief Justice of India impeached. According to the Constitution, first, the two Houses of Parliament need to address the impeachment. This will be followed by a vote in which the Houses will need a majority of two thirds. The voting will be presented to the President who will issue the impeachment if most are in favor.
