The Telangana High Court (HC,) on the 13th of December, issued a notice to Akbaruddin Owaisi, a member of the All India Majlis e Ittehadul Muslimeen (AIMIM.)

Justice G. Sri Devi issued the notice in relation to a petition filed against Mr. Owaisi.  The petition challenged the granting of bail to Akbaruddin Owaisi pertaining to a hate speech case.  The Telangana HC asked Akbaruddin Owaisi to explain his case related to the petition and defend himself.

Advocate K. Karuna Sagar moved the Telangana HC and filed a petition demanding cancellation of the bail granted to Owaisi in the 2018 Nizamabad hate speech case.

In the 2018 Telangana Assembly elections, the AIMIM leader addressed a public rally in Adilabad, Nizamabad, where he delivered a 15 minute hate provoking speech.  Soon, a case was filed against Mr. Owaisi, claiming his speech was in violation of the Model Code of Conduct (MCC) imposed during elections. This is not the first time Akbaruddin Owaisi was alleged of delivering hate speech.  In 2013 and 2016, Akbaruddin organised public rallies and tried to instigate the public with his communal hate speech.

However, a special sessions court of Hyderabad reviewed the petition and granted him bail with a warning.  Despite being warned, Akbaruddin Owaisi continued to give hate speeches at various public rallies during his election campaign.

When Karuna Sagar filed a petition seeking the cancellation of the bail granted to Owaisi, the Hyderabad Court dismissed it, following which Karuna Sagar moved the Telangana HC.

In his petition, Karuna Sagar wrote, “The above named petitioner begs to present this Memorandum of Criminal Revision Case to this court against the dismissal order Dt. 26-09-2019 on the file of Special Sessions Judge, Hyderabad, for the trial of MP and MLA cases for the following among other grounds.”  The petition further read, “That the court below (Hyderabad Court) miss interpreted the relief claimed by the petitioner as if he sought the relief over the pending case at Nirmal court whereas the relief sought, i.e., seeking cancellation of bail granted to the accused, i.e., respondent No.1 (Akbaruddin Owaisi) is pertaining to the subject case, i.e., CC No. 28 of 2018 pending on the court below, i.e., Special Sessions Judge, Hyderabad for the Trial of MP and MLA cases.”

Akbaruddin Owaisi is yet to respond to the notice issued to him by the Telangana HC.
